What Happens to the Automatic Stay if My Bankruptcy Case Is Dismissed?


If your bankruptcy case is dismissed, the automatic stay will be lifted and creditors will be able to pursue collection again. If you had filed for Chapter 7 bankruptcy, this means that creditors can begin garnishing wages and levying bank accounts. If you had filed for Chapter 13 bankruptcy, this means that the repayment plan is no longer in place and creditors can demand the full amount owed.


The good news is that if your case is dismissed, you can still file for bankruptcy again. The automatic stay will go into effect as soon as you file your new case. However, it's important to note that if your case is dismissed twice within a year, the automatic stay may not apply.
