Can Social Security Legally Check My Bank Account?


The Social Security Administration (SSA) has the legal right to check an individual's bank account when determining if that person is eligible for benefits. However, the SSA must follow certain procedures when doing so.

First, the SSA must send a notice to the individual informing them that their bank account will be checked. The notice must explain why the check is being done and what rights the individual has. The notice must also give the individual an opportunity to object to the check.


If the individual does not object, then the SSA can proceed with checking their bank account. The SSA will only look at accounts that are relevant to their determination of eligibility for benefits. For example, they may look at accounts containing income or assets.


Once the SSA has finished checking the bank account, they will send another notice to the individual informing them of their decision.
